If you’ve ever done summer sales, you likely have a flat-brimmed hatand you probably signed a confession of judgment. COJs have been used commonly by summer sales companies to enable recovery of a future default of a sales rep who fails to make enough sales to cover their costs. The problem is these companies usually require the sales reps (or managers) to sign the COJs prior to beginning work. Utah’s recently enacted H.B. 199S01, in part, voids all COJs signed (1) after May 14, 2019, AND (2) preemptively before the default has occurred.
