There are far too many serious accidents occuring on our roads these days. It seems every day there is an article about someone dying or suffering life threatening injuries whether as pedestrians or in accidents clearly involving speeding. Cars being raced around the streets by drivers looking for a buzz or to show off. You might get away with it 99 times in a 100 but that one time you don't, you could kill a child, a pedestrian, a brother or sister, a friend or even yourself. We are hearing from more and more clients who have are having to live with life long conditions due to delayed treatment and misdiagnosis'. Unfortunately for some, their conditions are now beyond recovery and the frustrating thing is, it may have all been preventable. If the standard of care provided by a treating doctor falls below the standard expected of a reasonably competent doctor, the doctor can be found to have breached the duty it owed the patient under the Bolam T...est (Bolam v Friern Hospital Management Committee). If the delays and misdiagnosis are unreasonable, there maybe some financial restitution available to the injured person. The purpose of compensation is to put the injured party back in the position they would have been but for the act/omission which caused their injuries / illness. Although there is caselaw which may not sit well with this judgment, it is still worth noting.

A particularly bad junction in Bolton is throwing up more problems yet again. We have at least one on going claim in this area and it seems to be an area which needs looking at.
