RECENT CHANGES IN THE LAW Increasing the cap for small claims Small Claims Courts allow people to sue for damages in an informal manner. According to Courts.in.gov, these courts were created so that you would have a speedy, reasonably inexpensive, uncomplicated means of determination of your claim. ... There is, however, a filing cap for small claims. Effective July 1, 2020, IC 33-31-2-3 provides that the small claims filing cap was raised from $6,000 to $8,000 statewide. Heather Welch, Marion Superior Judge, said that Indianapolis courts have already been using the $8,000 limit for years and supports the new legislation. She explained that raising the cap increases uniformity in the law and benefits attorneys and nonlawyers who often litigate in small claims courts. What do you think of this new filing cap? RECENT CHANGES IN THE LAW Distracted Driving and Hands-Free Cell Phone Laws Indiana’s earlier distracted driving law was difficult for police to enforce. It previously banned typing, sending, and reading text messages and emails while driving.... Effective July 1, 2020 under IC 9-21-8-59, a person may not hold or use a cellphone while operating a moving motor vehicle. A cellphone may only legally be used in conjunction with hands free/voice operated technology or to call 911 to report a bona fide emergency. Under this new law, law enforcement can issue citations to drivers simply for having a cellphone in their hand, making the new law much easier for police to enforce than the previous version. A lieutenant with the Indianapolis Metropolitan Police Department explained that "[under] [t]he prior law they could view a website, use Google Maps and actually be reading while driving and were not in violation of the Distracted Driving Law. [Only] [i]f they typed, read, or sent a text message then they could be issued a ticket." Sgt. John Pierre of the Indiana State Police clarified that drivers can still use phones while driving, but the phone cannot be in their hand.
